20___ Stallion Breeding Contract
for Cooled Transported Semen

This Agreement entered into this _____ day of _________, 20___, is by and between Malissa Ferguson dba Carpe Diem Barrel Horses hereinafter referred to as “Breeder” and ____________________________, hereinafter referred to as “Mare Owner.” Mare Owner agrees to breed the mare ____________________, Registration #_______________, to the stallion Stylin Beau Jesse , #4468652, for the fee of $700, for a live foal, subject to the following conditions:
The breeding fee includes a non-refundable booking fee of $100, payable upon execution of this contract. All specified fees must be paid when the mare owner is invoiced or prior to first shipment, whichever comes first. Invoices are payable upon receipt. Balances remaining 30 days after invoice will be subject to finance charges at the rate of 2.0% monthly.
Mare Owner will be assessed $250 for each shipment. Semen will not be shipped until payment is received.
Mare Owner must provide a $30 non-refundable deposit for the use of the Equitainer, included.
All fees, including the booking fee, the balance of the breed fee, the $250 fee for first shipment, included in fee, and the shipping fees must be paid prior to the first shipment. Each additional shipment will be $250 paid in advance before semen is shipped.
Semen will be collected on an as-needed basis between February 15 and July 15th. Breeder agrees to diligently attempt to provide semen when requested. Mare Owner understands that the Breeder cannot guarantee that semen will be available on any given day. Breeder assumes responsibility to ship enough extended semen (in viable condition at the time of collection) to provide a minimum of 350 million progressively motile sperm to the Mare Owner. Breeder is not responsible for the untimely delivery or condition of cooled transported semen or semen that is mishandled in any way after leaving the breeding farm. Breeder also shall not be held responsible for shipments lost, damaged, or delayed in transit. Breeder is not responsible for mares inability to settle.
Mare Owner understands that it is vital to keep Breeder informed as to the breeding status of the mare and agrees to the following:
-notify Breeder one week prior to the start of mare’s cycle
-notify Breeder the day the mare enters estrus
-alert Breeder the day prior to needing a shipment
-call Breeder before 9:00 a.m. PST to verify or cancel that day’s shipment
Mare Owner agrees to have a qualified veterinarian or breeding technician inseminate the mare.
Mare Owner agrees to sign and return the paperwork included in each shipment to Breeder and to AQHA/APHA/ApHC as instructed. Mare Owner assumes responsibility for association documents, registration fees, and DNA typing needed for mare and/or resulting foal.
This contract includes a live foal guarantee. A live foal is described as a newborn foal that stands and nurses without assistance. If foal is born dead, there are return privileges for the following season only if Breeder is notified within ten days by a licensed veterinarian that the mare has slipped or produced a nonviable foal. If after being pronounced “safe-in-foal” the mare should miscarry, abort, or prove barren, Mare Owner may re-breed her during the current breeding season (February 15 –July 15) or during the 2012 breeding season only.
All second season rebreeds (regardless of reason) under this contract will require payment of a $100 non-refundable booking fee. A charge of $250 per shipment will apply to each shipment during the second season. All payments must be received prior to shipment.
In the event of the death or incapacity of the mare, Mare Owner has the opportunity to breed a substitute mare to the stallion, provided that the Breeder has given advance approval in writing of the proposed substitute mare. No refunds shall be made. In the event of the stallion’s death or unfitness for breeding during the current breeding season, the breed fee, minus the non-refundable booking fee, will be refunded.
A Breeder’s Certificate will be issued to Mare Owner after all expenses have been paid in full and upon notification of the birth of the foal.
All terms of this contract/addendum, including terms of second season rebreeds, are non-transferable.
